Welcome to Mellow Monkey Emporium . By accessing our Ecrater storefront and purchasing our handmade fabric wristlets, zipper pouches, magnets, waterproof stickers, scrunchies, or printed stationery (collectively, the "Products"), you agree to be bound by the following Terms of Service ("Terms"). Please read them carefully before placing an order.

1. Overview & Governing Law

These Terms govern your use of our online store. This storefront is operated on the Ecrater platform. These Terms and any separate agreements whereby we provide you Products shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to principles of conflicts of law. Any legal actions must be filed in the appropriate court located in Florida.

2. Product Safety & Choking Hazard Warnings (Florida Compliance)

We prioritize the safety of our customers. Please read the following warnings before purchasing or using our items:
• *CHOKING HAZARD – Small Parts: Several of our products—including but not limited to die-cut magnets, zipper pulls, keychains, and hair accessories—contain or use small components. These items are NOT toys.
• Age Restrictions: Our products are intended solely for adults and older children. Keep all magnets, stickers, and small accessories out of reach of infants, toddlers, and pets.
• Magnet Safety: Swallowed magnets can stick together across intestines causing serious infections or death. Seek immediate medical attention if magnets are swallowed or inhaled.
• Suffocation Hazard: All plastic packaging bags and wraps used during shipping should be kept away from babies and young children to avoid the danger of suffocation.

3. Handmade Product Disclaimers & Variations

Because our items are handmade, die-cut, and printed in small batches:
• Product Variations: Minor variations in fabric pattern placement, stitching, cut margins, and dimensions may occur. These are characteristics of unique handcrafted items, not defects.
• Color Accuracy: We make every effort to display the colors of our products as accurately as possible. However, we cannot guarantee that your monitor or phone screen will display colors with perfect accuracy.
• Sticker & Magnet Use: Our stickers are laminated and waterproof, but intentional soaking, dishwashing machines, or exposure to extreme weather may degrade them over time.

4. Pricing and Payments

• Currency: All prices are listed in U.S. Dollars (USD).
• Price Changes: Prices for our products are subject to change without notice.
• Sales Tax: In accordance with Florida Department of Revenue regulations, sales tax will be automatically calculated and charged to orders shipping to Florida addresses, or as required under marketplace facilitator laws.
• Payment Security: Payments are securely processed through Ecrater’s approved third-party gateways (e.g., PayPal or Stripe). We never see or store your full credit card information.

5. Shipping and Processing Time

• Processing Time: Because our items are carefully handcrafted, please allow 1 to 3 business days for your order to be processed, packed, and shipped.
• Shipping Address: The buyer is responsible for providing a correct and complete shipping address. We are not responsible for packages delivered to an incorrectly entered address.
• Risk of Loss: All items are shipped via third-party carriers (e.g., USPS). The risk of loss and title for physical items pass to you upon our delivery to the carrier. We are not responsible for mail carrier delays or packages stolen after tracking marks them as "Delivered."

6. Returns, Refunds, and Exchanges

• Return Window: Most items may be returned within 14 business days of the delivery date shown on your tracking info.
• Condition of Returns: To be eligible for a refund, items must be returned in their original, unused, and unaltered condition.
• Return Shipping: The buyer is responsible for return shipping costs. We highly recommend using a trackable shipping service, as we cannot guarantee that we will receive your returned item.
• Damaged Items: If an item arrives damaged due to a manufacturing defect or shipping mishap, please contact us at our public email address within 7 days of receipt with photo proof, and we will gladly arrange a replacement or refund.

7. Intellectual Property

All original designs, artwork, product illustrations, text, and photos displayed on this storefront are the intellectual property of Mellow Monkey Emporium. You may not copy, reproduce, resell, or redistribute our sticker designs, postcard artwork, or fabric patterns without explicit written permission.

8. Limitation of Liability

To the maximum extent permitted by Florida law, Mellow Monkey Emporium shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from the use of, or inability to use, our products. This includes but is not limited to choking incidents, skin reactions to fabrics, or surface damage from magnets or sticker adhesives.

9. Changes to Terms of Service

We reserve the right to update, change, or replace any part of these Terms at any time by posting updates to our shop. It is your responsibility to check this page periodically for changes.
